プライバシーポリシー

株式会社マカルーデジタル(以下「当社」)は、当社が取得するお客様の個人情報を、下記のプライバシーポリシー(以下「本ポリシー」)に基づいて取り扱います。但し、当社が提供する各サービスにおいてプライバシーポリシーが別途定められている場合には各サービスにおいて別途定められたプライバシーポリシーが優先して適用されるものとします。

1.法令等の遵守

当社は、お客様の個人情報とプライバシーの保護実現のため、個人情報の保護に関する法律(以下「個人情報保護法」)、各省庁ガイドラインその他関連する法令等を遵守します。

2.個人情報の適正な取得

当社は、適正に個人情報を取得し、偽りその他不正の手段によって取得しません。

3.取得する利用者情報

本ポリシーにおける「個人情報」とは、個人情報保護法第2条第1項に定義される「個人情報」および本ポリシーに基づき当社が取得する以下の情報のうち、特定の個人を識別することができる情報です。

①当社ウェブサイトのお問い合わせフォームにお客様が入力する情報

・氏名、生年月日、住所、電話番号、メールアドレス等

②当社開催の講演会・セミナーにおいてお客様から取得する情報

・氏名、生年月日、住所、電話番号、メールアドレス等(参加申込時に頂いた情報、アンケートに記載していただいた情報、頂いたお名刺に記載されている情報を含みます。)

③当社サービスご利用時にお客様から取得する情報

・氏名、生年月日、住所、電話番号、メールアドレス等

・端末情報(当社サービスの提供・維持・改善のためまたは不正行為防止のため、利用者が使用する端末の固有情報を取得する場合があります。)

・ログ情報および行動履歴情報(当社サービスの提供・維持・改善のためまたは不正行為防止のため、当社サービス利用時に自動で生成、保存されるIPアドレス、当社サービス利用者からのリクエスト日時等を取得する場合があります。当社は、特定の個人を識別することができる限りにおいて、利用者のログ情報および行動履歴情報を個人情報として取り扱います。)

・Cookie(クッキー)/LocalStorage(ローカルストレージ)(当社サービス利用者の端末を特定する目的でクッキーまたはローカルストレージを設定する場合があります。当社は、特定の個人を識別することができる限りにおいて、利用者のクッキーまたはローカルストレージに関する情報を個人情報として取り扱います。)

4.利用目的

(1)当社は、取得した利用者情報を、以下の目的のために利用します。

①当社サービス、講演会・セミナーに関する登録、本人確認、提供、管理、運営、維持、保護および改善のため

②お客様からのお問い合わせに対する調査・回答のため

③当社サービス、講演会・セミナーに関するご案内を発信するため

④当社または第三者に対する違法行為ならびに利用規約等違反行為に対する対応のため

⑤当社サービスの利用規約その他利用ルールの変更等を通知するため

⑥その他利用目的を別途明示して利用者情報を取得する場合において、明示された当該利用目的のため

⑦上記の利用目的に付随する利用目的のため

(2)当社は、前項の利用目的を変更する場合には、変更前の利用目的と関連性を有すると合理的に認められる範囲を超えて行わず、変更された利用目的について、本人に通知または公表します。

(3)上記利用目的にかかわらず、以下の場合には、必要な限りにおいて、本人の同意を得ずに個人情報を取り扱う場合があります。

①法令に基づく場合

②人の生命、身体又は財産の保護のために必要がある場合であって、本人の同意を得ることが困難であるとき。

③公衆衛生の向上又は児童の健全な育成の推進のために特に必要がある場合であって、本人の同意を得ることが困難であるとき。

④国の機関若しくは地方公共団体又はその委託を受けた者が法令の定める事務を遂行することに対して協力する必要がある場合であって、本人の同意を得ることにより当該事務の遂行に支障を及ぼすおそれがあるとき。

5.第三者への提供

当社は、個人情報保護法により認められる以下の場合を除き、あらかじめ本人の同意なしに、利用者の個人データ(個人情報データベースを構成する個人情報であって個人情報保護法第2条第4項に定義されるもの。以下同じ。)を第三者に提供しません。

①法令に基づく場合

②人の生命、身体又は財産の保護のために必要がある場合であって、本人の同意を得ることが困難であるとき。

③公衆衛生の向上又は児童の健全な育成の推進のために特に必要がある場合であって、本人の同意を得ることが困難であるとき。

④国の機関若しくは地方公共団体又はその委託を受けた者が法令の定める事務を遂行することに対して協力する必要がある場合であって、本人の同意を得ることにより当該事務の遂行に支障を及ぼすおそれがあるとき。

⑤当社が、利用目的達成に必要な範囲において個人データの取扱いの全部または一部を第三者に委託する場合。

⑥合併その他の事由による事業の承継に伴って個人データが第三者に提供される場合

⑦個人データを特定の者との間で共同して利用する場合(但し、その旨並びに共同して利用される個人データの項目、共同して利用する者の範囲、利用する者の利用目的及び当該個人データの管理について責任を有する者の氏名又は名称について、あらかじめ、本人に通知し、又は本人が容易に知り得る状態に置いているときに限ります。)。

6.個人データの管理

当社は、当社の保有する個人データの管理については適切な安全管理措置を実施し、個人情報の紛失、改ざん、漏洩などの防止に努めます。

7.個人データの開示

当社は、本人から、個人情報保護法の定めに基づき当社が保有する個人データの開示を求められたときは、本人からの請求であることを確認したうえで、本人に対して遅滞なく開示します(当該個人データが存在しない場合はその旨を通知します。)。ただし、個人情報保護法その他の法令により、当社が開示義務を負わない場合はこの限りではありません。なお、個人データの開示につきましては手数料(件に1件につき1000円)が発生するため、あらかじめご了承ください。

8.個人データの訂正および利用停止

当社は、本人から以下の各号の理由により、個人情報保護法の定めに基づき当社が保有する個人データの訂正、追加もしくは削除(以下「訂正等」)または利用停止もしくは消去(以下「利用停止等」)を求められたときは、本人からの請求であることを確認したうえで、遅滞なく必要な調査を行い、その結果に基づき、個人データの訂正等または利用停止等を行い、その旨を本人に通知します。なお、合理的な理由に基づいて訂正等または利用停止等を行わない旨の決定をしたときは、本人にその旨を通知します。

①当社が保有する個人データが事実でないという理由(訂正等)

②当社が保有する個人データがあらかじめ公表された利用目的の範囲を超えて取り扱われている理由(利用停止等)

③当社が保有する個人データが偽りその他不正の手段により取得されたものであるという理由(利用停止等)

9.本ポリシーの変更

(1) 当社は、個人情報の取扱いについて継続的な改善に努めるものとし、次の各号に定める場合、本ポリシーを変更する旨および変更後の内容ならびにその効力発生時期を当社が運営するウェブサイトにおける表示その他適切な方法により周知することにより、本ポリシーを変更できるものとします。

①本ポリシーの変更が、利用者の一般の利益に適合するとき

②本ポリシーの変更が、本ポリシーの目的に反せず、かつ、変更の必要性、変更後の内容の相当性およびその内容その他の変更にかかる事情に照らして合理的なものであるとき

(2) 前項による本ポリシーの変更後も利用者が本サービスの利用を継続した場合、変更後の本ポリシーの各条項について合意があったものとみなし、本ポリシーの変更の効力発生時期から変更後の本ポリシーが適用されるものとします。

Macareux Digital Inc. (hereafter: this company) handles the personal information that it acquires from customers based on the privacy policy (hereafter: the policy) outline below. However, where the privacy policy regarding the services this company provides is specified separately, said separately specified privacy policy shall take priority and be applied. 

1. Adhering to the Law

In order to protect the personal information of customers, this company will adhere to laws regarding personal information protection (hereafter: the Act on the Protection of Personal Information) and laws relating to the guidelines of each government ministry. 

2. The Fair Acquisition of Personal Information

This company acquires personal information fairly and does not use falsity or other fraudulent means to do so 

3. User Information that is Acquired

"Personal information" in this policy refers to information that allows one to identify who a specified individual is from that which is defined in Article 2, Item 1 in the the Act on the Protection of Personal Information and from the information that this company acquires below based on this policy. 

① The information customers fill out on inquiry forms on this company's website 

・Name, date of birth, address, telephone number, email address 

② Information acquired from customers at lectures and seminars held by this company 

・Name, date of birth, address, telephone number, email address (includes information received when applying to participate, information on questionnaires, and information written on business cards) 

③ Information acquired from customers when using this company's services 

・Name, date of birth, address, telephone number, email address 

・Device information (there are cases where this company may acquire specific information on devices that users use for the purpose of offering, maintaining, or improving this company's services or to prevent misconduct) 

・Log information and action history information (in order to offer, maintain, or improve this company's service, or to prevent misconduct, there are cases where data on automatically created and saved IP addresses as well as dates and times that users of this company's services made requests will be acquired. Only where this company can identify a specific individual will it handle users' log information and action history information as personal information) 

・Cookies/Local storage (there are cases where cookies and local storage may be set in order to identify the devices of users of this company's services. Only where this company can identify a specific individual will it handle cookies and local storage as personal information) 

4. Purpose of Use

(1) This company uses information acquired on users for the following purposes. 

① For the purposes of registration, identity confirmation, provision, management, operation, maintenance, protection, and improvement of this company's services, lectures, and seminars 

② To examine and answer inquiries from customers 

③ To provide guidance for this company's services, lectures, and seminars 

④ To deal with illegal conduct and acts in violation of the terms and conditions of this company or a third party 

⑤ To notify parties about changes to terms and conditions of this company's services or other rules 

⑥ For clearly specified relevant purposes of use when other purposes of use are clearly specified separately and user information is acquired 

⑦ For purposes of use that accompany the above 

(2) In the event that the purposes of use outlined in the previous item are changed by this company, a notification will be sent to the party concerned or an official announcement made regarding the purposes of use that have been changed if it cannot be rationally determined that the updated content has enough relevance to the purposes of use prior to changes. 

(3) Regardless of the above purposes of use, where necessary, in the following situations, a party's personal information nay be handled without their approval. 

① In accordance with the law 

② For the protection of a person's life, body, or property and it is difficult to gain the approval of the party concerned. 

③ When especially necessary for the improvement of public hygiene or the healthy rearing of children and it is difficult to acquire the approval of the party concerned. 

④ When it is necessary to cooperate with national institutions, local public entities, or entities commissioned by them in carrying out official work outlined by the law and acquiring the approval of the party involved will interfere with said work. 

5. Providing Information to Third Parties

Excluding the following situations where it is recognized in the Act on the Protection of Personal Information, this company will not provide users’ personal data (personal information that composes the personal information database and is defined in Item 4, Article 2, Act on the Protection of Personal Information. The same shall apply hereafter) to third parties without acquiring their approval in advance.

① In accordance with the law 

② For the protection of a person's life, body, or property and it is difficult to gain the approval of the party concerned. 

③ When especially necessary for the improvement of public hygiene or the healthy rearing of children and it is difficult to acquire the approval of the party concerned. 

④ When it is necessary to cooperate with national institutions, local public entities, or entities commissioned by them in carrying out official work outlined by the law and acquiring the approval of the party involved will interfere with said work.

⑤ Where necessary to achieve the purpose of use, this company may outsource the handling of all or part of the personal data to a third party.

⑥ Where there is a succession of the business due to a merger or similar reasons, personal data may be provided to third parties.

⑦ Where personal data is shared and used with another specific party (however, this and the personal data items that are to be used in cooperation, the scope of which what will be used in cooperation, the purpose of use and the names of those responsible for managing the relevant personal data will all be notified to the party concerned in advance and only in a form that is easy for the party concerned to know about). 

6. Managing Personal Data

This company will implement the appropriate safety control measures in managing the personal data it possesses and will do its utmost to prevent the loss, falsification, and leakage of it.

7. The Disclosure of Personal Data

When this company is required to disclose the personal data it has obtained from parties concerned based on that which is stipulated in the Act on the Protection of Personal Information, upon confirming that this request has come from the party themselves, this company will disclosure said data to the party concerned without delay (if no such relevant data exists, the party shall be informed as such). However, this shall not apply in cases where this company is not obliged to disclose information based on the Act on the Protection of Personal Information or other laws. Moreover, please note that there is a handling fee for disclosing personal data (1000 Japanese Yen per item). 

8. The Correction and Discontinuation of Use of Personal Data

When this company is requested by the party concerned to correct, add, or delete (hereafter: correct, etc.) or discontinue the use of or erase (hereafter: discontinue the use of, etc.) the personal data it possesses based on the Act on the Protection of Personal Information for the reasons in one of the following items, upon confirming the request has been made by the party concerned themselves, this company will conduct the necessary inquiries without delay and, depending on the results of which, will correct, etc. or discontinue the use of, etc. and notify the party concerned of this. Moreover, based on rational reasoning, if it is decided not to correct, etc. or discontinue the use of, etc., the party concerned will also be notified. 

① Due to the personal data this company possesses not being factual (correct, etc.)

② Due to the personal data that this company possesses being handled outside the scope of what was officially announced in advance (discontinue the use of, etc.)

③ Due to the personal data this company possesses being false or having been acquired through unjust means (discontinue the use of, etc.) 

9. Changes to This Policy

(1) This company will constantly strive to improve its handling of personal information and, in cases where it is stipulated in the following items, shall be allowed to change this policy by displaying details regarding its intentions to change the policy, the content after said changes, and the period from which changes will be effective on the website it runs or by notifying through other appropriate means. 

① When changes to this policy are in the general best interests of the user

② When changes to this policy are not contrary to the purpose of this policy and the necessity of the changes and the appropriateness of the content after said changes have been made are all deemed to be rational in light of the circumstances surrounding said changes 

(2) If the user continues to use this service after changes are made to this policy as outlined in the previous item, the user will be considered to have agreed to each item of the changed policy and once the changes to this policy come into effect, the updated policy will be applied.
